California’s latest legislation on artificial intelligence has sparked a fierce debate, with opinions as divided as a room full of tech enthusiasts arguing over the best programming language.
On August 28, the state Senate passed the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act (SB 1047)—a mouthful of a bill that essentially demands AI companies install an emergency stop button, or AI “killswitch.”
The vote wasn’t even close, with the bill sailing through 29 to 9. Now, it’s up to Governor Gavin Newsom to decide if this idea will officially become law.
Industry Leaders Weigh In
Elon Musk, always one for a hot take, cautiously backed the bill. He admitted it was a “tough call” but ultimately leaned in favor, citing the potential risks AI could pose.
However, not everyone shares Musk’s view.
Jason Kwon, OpenAI’s chief strategy officer, isn’t thrilled, and neither is Calanthia Mei, co-founder of the decentralized AI network Masa.
Mei likens the legislation to trying to stop a speeding train with a paper wall—an effort she sees as both ineffective and premature.
She fears California’s rush to regulate could drive AI talent not just out of the state but out of the country altogether.
“We’ve seen this before with crypto,” Mei warns, a clear sign to those pushing the bill forward that it may have unintended consequences.
On the flip side, Raheel Govindji, CEO of DecideAI, argues that a little regulation might be just what the AI industry needs to stay healthy.

Govindji’s idea of a DAO-controlled killswitch is an intriguing one, offering a blend of regulation and community oversight.
The bill requires that AI models must be capable of a “prompt shutdown,” but what exactly does “prompt” mean?

Govindji thinks a DAO could make these emergency decisions in a way that’s both fast and fair, ensuring AI’s growth is tempered by a democratic approach.
Meanwhile, AI company Anthropic is standing behind the bill.
In an open letter to Governor Newsom, Anthropic’s CEO, Dario Amodei, acknowledged that while AI’s rapid development is exciting, it also comes with risks that can’t be ignored.
He believes the latest version of SB 1047, especially after some industry-friendly tweaks, is something companies like his can work with.
So all in all this can be a balancing act—avoiding catastrophic misuse without choking off innovation.
Where Does AI Regulation Go from Here?
So, what’s the deal with this bill? Initially, it’s targeting “covered models”—those AI systems that cost more than $100 million to develop or that run on some serious computing power.
But this definition could evolve over time, with the federal Government Operations Agency acting like the referee in this high-stakes game.
